The measure derived from a complaint by Morena after the third presidential debate
The Complaints and Denunciations Commission of the National Electoral Institute (INE) ordered the presidential candidate of the PAN, PRI and PRD coalition, Xóchitl Gálvez, to refrain from calling Morena a "narcopartido." The decision was made to avoid the accusation of a false crime, which could constitute slander.
This resolution originated from a complaint filed by Morena against the Fuerza y Corazón X México candidate, due to her statements during the third presidential debate. In addition, the commission approved measures to eliminate the expression "narcoparty" from the stenographic version of the debate.
The draft resolution indicates that the phrase "narco party" could constitute the imputation of false facts and crimes against Morena, presenting the party to citizens as an institution linked to illicit activities, specifically drug trafficking.
Claudia Zavala, counselor and president of the commission, proposed approving preventive guardianship, citing a similar precedent when Xóchitl Gálvez called Claudia Sheinbaum, from the Let's Make History coalition, a "narco-candidate."
"It seems to me that we are in a position to dictate preventive protection, because the analysis suggests that it has to do with an illicit organization. The words in propaganda or in debates must be careful not to imply criminal organizations," Zavala explained.
The counselor stressed that, although there will no longer be formal debates organized by the INE, the campaign continues, and it is important to prevent the use of expressions that imply criminal organization, since these could constitute slander.
Finally, Zavala mentioned that an appeal filed in the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) against a previous decision of the Complaints and Denunciations Commission is still pending resolution.
"Our decision continues to take effect until it is revoked or modified by the Superior Court," he concluded.
